Public contracts are essential for the development of Free Software, and Free Software conversely has major assets for public actors : its durability and openness as well as the use of open standards are crucial for many administrations. Yet some public tenders sometimes explicitly exclude Freee Software as well as other alternatives by demanding a specific brand or technology in their software procurements.

2010 can be seen as a landmark in the legal fight on such issues ; recent court decisions in Québec and Italy, as well as the evolution of procurement policies in the UK, have shown that the issue is under public scrutiny and that solutions are being sought.

This conference aims at developing an overview of the current situation regarding Free Software and public procurement and at making a first assessment of the potential evolutions for public administrations, private organizations and citizens.
